Terms & conditions

The agreement between your society, you, and Twocompo Technologies Private Limited. Written as plainly as a contract can be written.

1. Accepting these terms

These terms govern the use of the GateChecker platform — the website at gatechecker.in, the mobile apps, and the committee web panel — operated by Twocompo Technologies Private Limited ("Twocompo", "we", "us"), a company incorporated in India with its place of business in Ahmedabad, Gujarat.

By registering for, signing into or using GateChecker, you agree to these terms. If you are accepting on behalf of a society, you confirm you are authorised by its committee to do so. If you do not agree, do not use the platform.

We may also agree specific terms with a society in a separate written agreement or order form. Where that agreement conflicts with these terms, the agreement prevails for that society.

2. Definitions

  • Society — the housing society, association or similar body that uses GateChecker.
  • Committee — the office bearers and members the society authorises to administer its account.
  • User — anyone signing in: a resident, an owner, a tenant, a family member, a guard or a committee member.
  • Society Data — everything entered into the platform for a society: units, residents, vehicles, visitors, gate records, notices, complaints.
  • Agreement — any separate written agreement, order form or commercial terms we agree with a society.

3. Accounts and eligibility

  • You must be 18 or older to hold an account.
  • Your mobile number is your identity on the platform. Keep it, and any one-time code sent to it, to yourself.
  • You are responsible for what happens under your account. Tell us at once if you think someone else has access to it.
  • A user may belong to more than one society. Access in each is decided by that society's committee.
  • The society's committee approves, suspends and removes its own members. We act on the committee's instructions, not on a resident's request, for membership matters.

4. The society's responsibilities

  • Keep unit, resident and vehicle records accurate, and remove people who have moved out.
  • Grant committee permissions carefully. Anyone you make an administrator can see what that role allows.
  • Make sure guards are trained, and that visitors are told their details and photograph are being recorded for the society's register.
  • Use the platform lawfully — including under the Digital Personal Data Protection Act, 2023, for which the society is the Data Fiduciary for its own records — and obtain any notices or consents that the law requires from residents, visitors and staff.
  • Keep gate devices and committee logins secure.
  • Make sure its users follow these terms. The society is responsible for the acts of its committee, guards and other users on the platform.

5. Our responsibilities

  • Provide the platform with reasonable skill and care, with the features we make available from time to time.
  • Protect Society Data as described in the privacy policy.
  • Keep each society's data separated from every other society's.
  • Provide support through the channels and during the hours we publish from time to time.

6. Fees and taxes

  • GateChecker is currently provided at no charge.
  • We may introduce fees or change our pricing and commercial terms. Any fees, what they cover and how they are paid will be as set out in the applicable Agreement or in the terms we communicate to the society.
  • Fees are exclusive of GST and other applicable taxes, which are charged additionally as the law requires.
  • Hardware — phones, tablets, printers, barriers — is not included and is bought by the society directly.

7. Paid plans, cancellation and refunds

  • Where a society uses a paid plan, its term, renewal, cancellation and any refund are governed by the applicable Agreement or commercial terms.
  • Unless the applicable Agreement or the law provides otherwise, fees paid are non-refundable, and setup and other services already delivered are not refundable.
  • A society may stop using GateChecker at any time by writing to info@gatechecker.in, subject to any Agreement it has with us.

8. Acceptable use

You must not:

  • Use GateChecker to harass, profile or keep watch on any person beyond what running the gate requires.
  • Share a login, or let anyone use the guard app who is not on duty for that society.
  • Export or copy resident data for anything other than the society's own administration. It must never be sold, or passed to a marketer or a political campaign.
  • Upload anything unlawful, defamatory or obscene, or a document you have no right to upload.
  • Enter false gate records, or use the guard override to bypass residents as a routine.
  • Probe, scrape, reverse engineer, overload or attempt to break into the platform.
  • Resell or sublicense access without our written agreement.
  • Use the platform in breach of any law or of anyone else's rights.

A breach of this clause may lead us to suspend or terminate an account or a whole society under clause 17. Where reasonably practicable, we will inform the committee.

9. Data and privacy

  • Society Data belongs to the society. We claim no ownership of it.
  • We process it to run the service, as set out in the privacy policy, which forms part of these terms.
  • On request, we provide the society's data in a readable format within a reasonable time.
  • After a society's account is closed, we delete or anonymise its data within a reasonable period, except where we must keep it to comply with the law or need it for a legitimate purpose such as resolving a dispute.
  • We do not sell personal data.

10. Availability and support

  • We aim to keep the platform available, but we do not promise uninterrupted or error-free service. Maintenance, network failures, power cuts at a gate and events outside our control can interrupt it.
  • We may carry out maintenance at any time, and try to announce planned maintenance beforehand where we reasonably can.
  • Support is offered through the channels, during the hours and in the languages we publish from time to time.
  • GateChecker records and communicates; it does not physically secure anything. It does not replace guards, locks, barriers or the police, and we are not responsible for what a guard, a resident or a visitor decides to do.
  • SOS alerts are not an emergency service. They notify guards and committee members through the app. In a real emergency, call 112, 100, 101 or 108 first.

11. Changes to the service

  • We develop GateChecker continuously. We may add, change, suspend or remove any feature, module or app, and we may modify, suspend or discontinue the platform in whole or in part, at any time, to the extent the law allows.
  • Where reasonably practicable, we will tell affected societies about a significant change, by email, in the apps or on this website.
  • Nothing on this website or in our materials is a promise that a particular feature will remain available.

12. Intellectual property

GateChecker, its software, design, documentation, name and logo are owned by Twocompo Technologies Private Limited. While we provide access, the society and its users have a limited, non-exclusive, non-transferable and revocable right to use the platform for the society's own administration. All other rights are reserved. You may not copy, modify, or create derivative works from the platform, or use the GateChecker name or logo without our written consent.

If you send us an idea or a suggestion, we may use it to improve the product without owing you anything for it.

13. Third-party services

The platform depends on services we do not control — mobile networks, SMS gateways, Google Firebase for push notifications, app stores and hosting providers. Their failures can interrupt GateChecker, and their own terms apply to their part. We are not responsible for their acts, failures or delays.

14. Disclaimers

To the extent the law allows, the platform is provided "as is" and "as available", without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose or non-infringement. We do not warrant that it will be error-free or uninterrupted, that every record will be complete where a guard failed to make an entry, or that it will meet a requirement we have not agreed to in writing.

15. Limitation of liability

To the extent the law allows:

  • Neither party is liable for indirect or consequential loss, loss of profit, loss of goodwill, loss of data or loss of business opportunity.
  • Our total liability arising out of or in connection with these terms or the platform is limited to the fees the society actually paid us in the twelve months before the event giving rise to the claim.
  • We are not liable for theft, trespass, injury, property damage or any incident at or beyond the gate. GateChecker is a record-keeping and communication tool; the security of the premises remains the society's responsibility.
  • We are not liable for loss caused by the misuse of the platform, by inaccurate records entered by a society or its users, or by a third-party service.
  • Nothing here limits liability that cannot be limited by law, including for fraud or for death or personal injury caused by negligence.

16. Indemnity

The society will indemnify Twocompo, its officers and employees against claims, losses and costs arising from: the use of the platform by the society or its users; content, documents or records the society or its users upload or maintain; a breach of these terms by the society or its users; or a breach of any law or of anyone else's rights by the society or its users — except to the extent the claim is caused by our fraud or wilful misconduct.

17. Suspension and termination

  • We may suspend or terminate access for any user or society, or stop providing the platform, at any time — including for a breach of these terms, unlawful use, a legal or regulatory requirement, a risk to the platform or to other societies, non-payment, or because we discontinue the service — subject to the law and to any Agreement with that society.
  • Where reasonably practicable, we will inform the committee, and the society may ask for an export of its data under clause 9.
  • A society may stop using the platform at any time, subject to any Agreement it has with us.
  • On termination, access stops, and the data handling in clause 9 applies. Clauses that by their nature should continue — including data, intellectual property, disclaimers, limitation of liability, indemnity and governing law — survive termination.

18. Governing law and disputes

These terms are governed by the laws of India. The courts at Ahmedabad, Gujarat have exclusive jurisdiction, subject to the following.

Before going to court, both parties will try in good faith to settle the dispute — first by discussion between the committee and our team, and then, if that does not resolve it within a reasonable time, by mediation. This does not stop either party from seeking urgent interim relief.

19. Changes to these terms

We may update these terms from time to time. The updated terms apply from the date they are published here unless they say otherwise. Where the law or an Agreement requires us to give notice of a change, we will give it as required. Continuing to use the platform after a change takes effect means accepting it. If you do not accept a change, you must stop using the platform.

20. General

  • Events outside our control. We are not responsible for a delay or failure caused by events beyond our reasonable control, including network or power failures, failures of third-party services, natural events, or actions of government.
  • Assignment. We may transfer our rights and obligations under these terms, including as part of a reorganisation, merger or sale of the business. A society may not transfer its rights without our written consent.
  • Severability. If any part of these terms is found unenforceable, the rest remains in effect.
  • No waiver. Not enforcing a right straight away does not mean we give it up.
  • Entire agreement. These terms, the privacy policy and any Agreement with a society are the whole agreement about the platform.
